1. About the Service

MomentSift is an AI-assisted tool for culling, organizing, enhancing, and creating photos, offering local culling analysis, manual comparison culling, library management, AI Enhancement, AI Text-to-Image, AI Image-to-Image, credits, and subscriptions. By accessing or using this service, you agree to these Terms of Service and our Privacy Policy.

2. Account and Security

You need to provide a real, valid email address to register and receive account notifications. You're responsible for keeping your account and password secure and for activity that occurs under your account. If you discover unauthorized use of your account, please contact us promptly at support@momentsift.com .

3. Credits, Subscriptions, and Payment

Some AI features consume credits, such as AI Enhancement, AI Text-to-Image, AI Image-to-Image, and other cloud processing features. Credits can be earned through sign-up bonuses, subscription plans, or credit packs. Exact prices, quotas, validity periods, and available features are as shown on the pricing and checkout pages.

If a job is charged but fails due to a system error, an upstream service failure, or our inability to complete processing, the system may automatically refund the corresponding credits. Once a request has been submitted normally and processing has completed, credits already consumed are generally non-refundable, except where required by law or otherwise stated by us.

Subscriptions renew automatically as described on the checkout page until you cancel. After cancelling, you can still use the subscription benefits you've already paid for until the end of the current billing cycle.

4. User Content and License

Photos, reference images, text prompts, generated results, and other content you upload remain owned by you or the original rights holder. You grant MomentSift a necessary, limited license to host, transmit, process, generate, display, and let you download this content, in order to provide the service you requested, handle issues, maintain security, and meet legal obligations.

You represent that you have the rights and authorization needed to upload, process, and use the relevant content, and that doing so won't infringe anyone else's image rights, privacy, copyright, trademark, or other legal rights.

5. Prohibited Content

You may not upload or generate the following content:

• Pornographic, obscene, or child sexual abuse material
• Hate speech, violence, self-harm, or terrorism-related content
• Unauthorized real-person nudity, intimate imagery, deepfakes, or content impersonating someone else
• Content that infringes copyright, trademark, image rights, privacy, or other third-party rights
• Content that violates applicable laws and regulations or the platform rules of the region where it will be published
• Content used for forging documents, fraud, phishing, harassment, defamation, or other unlawful purposes

If we believe content or conduct violates these Terms, we may refuse to process it, remove content, restrict features, suspend or terminate accounts, and cooperate with law enforcement or rights holders where necessary.

6. Other Prohibited Conduct

• Using automated scripts to bypass rate limits or abuse our APIs
• Attempting to crack, reverse-engineer, or interfere with the normal operation of the service
• Creating multiple accounts to farm free credits
• Bypassing payment, credit, subscription, or access-control mechanisms
• Uploading photos containing other people's private information for unauthorized purposes

7. Third-Party Services

This service relies on third-party account authentication, hosting, storage, payment, email, AI model, and security services. When using related features, you understand relevant data may be sent to these third-party providers in accordance with our Privacy Policy, and is subject to their respective terms.

AI image generation, AI image-to-image, photo editing, enhancement, restoration, background replacement, stylization, and similar features may be powered by third-party AI model providers or hosted model platforms. Representative providers or model families may include Seedream/Jimeng, Flux, Nano Banana, OpenAI-compatible image models, and other equivalent services we configure from time to time.

For content safety and payment-platform compliance, user-supplied prompts intended for image or video generation are screened before generation. Prompts that are rejected, flagged, or cannot be screened due to a moderation service failure may be blocked and will not be forwarded to the image model.

8. AI Output and Responsibility for Use

AI analysis, scores, culling suggestions, enhancement results, and generated results may be inaccurate, incomplete, or not match your subjective expectations. You're responsible for judging whether output is suitable for publication, commercial use, printing, or client delivery, and you bear responsibility for any consequences of using that output.

9. Service Changes and Availability

We may adjust features, models, pricing, credit rules, quotas, and available regions based on product iteration, cost, vendor capabilities, security, or compliance requirements. We try to keep the service stable, but we don't guarantee it will always be uninterrupted, error-free, or permanently available.

10. Disclaimer and Limitation of Liability

MomentSift is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we are not liable for indirect losses, loss of profits, data loss, business interruption, or losses caused by third-party services.

11. Changes to These Terms

We reserve the right to modify these Terms at any time; material changes will be communicated via an in-app notice or email. Continued use of the service constitutes acceptance of the changes.
